3725 - Abu Bakra and Ali ibn Mabad narrated to us, they said: Makki ibn Ibrahim narrated to us, he said: Dawud ibn Yazid al-Awdi narrated to us, he said: I heard Abdulmalik ibn Maysara al-Zarrad, he said: I heard al-Nazzal ibn Sabra saying: I heard Suraqa ibn Malik ibn Jushum saying: I heard the Messenger of Allah (peace and blessings of Allah be upon him) saying: Umra has entered into Hajj until the Day of Judgment. He said: And the Messenger of Allah (peace and blessings of Allah be upon him) combined in the Farewell Hajj. They differed from the Prophet (peace and blessings of Allah be upon him) about his ihram in the Farewell Hajj, what it was, and they said what we have narrated, and they disputed in that as we have mentioned. And our knowledge has encompassed that it could only have been upon one of those three states: either mutamatti, or mufrid, or qarin. So it is most proper for us to look at the meanings of these reports and uncover them, to know whence their disagreement came, and to establish thereby what his ihram (peace and blessings of Allah be upon him) was. So we considered that, and we found those who say he performed ifrad saying: his ihram was for Hajj alone, with no ihram before that for anything else. And others said: rather, before his ihram for that Hajj he had entered ihram for Umra, then added this Hajj to it; thus say those who said he performed qiran. And Jabir, may Allah be pleased with him, informed in his hadith, and he is one of those who said the Prophet (peace and blessings of Allah be upon him) performed ifrad, that the Messenger of Allah (peace and blessings of Allah be upon him) entered ihram for Hajj when his she-camel rose with him upon al-Bayda. And Ibn Umar said: from the mosque, and he is also among those who said the Messenger of Allah (peace and blessings of Allah be upon him) performed ifrad of Hajj at the beginning of his ihram. So the start of his ihram, upon him be peace, according to Ibn Umar and Jabir, may Allah be pleased with them, was after his leaving the mosque. And we have already explained from him in what preceded in this book of ours that he had entered ihram at the end of the prayer in the mosque. So it is possible that those who said he performed qiran heard his talbiya in the mosque for Umra, then heard after that his other talbiya, outside the mosque, for Hajj alone, so they knew that he performed qiran; and those who said he performed ifrad heard him when he called out the talbiya for Hajj alone, and had not heard his talbiya before that for Umra, so they said: he performed ifrad; and some people also heard him when he called out the talbiya in the mosque for Umra, and did not hear his talbiya after leaving it for Hajj, then saw him after that doing what the pilgrim does of standing at Arafa and the like, and that was, in their view, after his exit from Umra, so they said: he performed tamattu; so each group narrated what it knew. And all that those who said ifrad knew, and what those who said he performed tamattu knew, is included in what those who said he performed qiran knew, for they reported of his talbiya for Umra, then of his talbiya for Hajj immediately after that. So what they held of that and what they narrated is more worthy than what those who opposed them held and narrated. Then we found after that the deeds of the Messenger of Allah (peace and blessings of Allah be upon him) proving that he was a qarin, and that is that there is no disagreement from him that when he arrived at Mecca he commanded his Companions to exit ihram except those among them who had driven a sacrificial animal, while he remained upon his ihram, and did not exit from it except at the time when the pilgrim exits from his Hajj. And he said: Had I known beforehand what I have come to know afterwards, I would not have driven the sacrificial animal and I would have made it an Umra; so whoever does not have a sacrificial animal with him, let him exit ihram and make it an Umra. Thus Jabir ibn Abdullah narrated from him, and he is among those who say he performed ifrad, and we shall mention that and what was narrated therein in the chapter of faskh al-Hajj, Allah willing. So had that ihram of his been for Hajj, his sacrificial animal which he drove would have been voluntary, and voluntary sacrificial animals do not prevent the exiting of ihram which a man performs when he has no sacrificial animal with him, and his ruling (peace and blessings of Allah be upon him), though he had driven a sacrificial animal, would have been like the ruling of one who had not driven a sacrificial animal, for he had not set out to perform tamattu, so that that sacrificial animal would be for tamattu and would prevent him from the exiting of ihram which he would have performed had he not driven a sacrificial animal. Do you not see that had a man set out intending tamattu and entered ihram for Umra, then when he circumambulates for it, runs, and shaves, he exits from it, and had he driven a sacrificial animal for his tamattu he would not exit until the Day of Sacrifice, while had he driven a voluntary sacrificial animal he would exit before the Day of Sacrifice after finishing Umra. So it is established thereby that the sacrificial animal of the Prophet (peace and blessings of Allah be upon him), since it prevented him from exiting ihram and necessitated his remaining upon ihram until the Day of Sacrifice, its ruling is other than the ruling of voluntary sacrificial animals, and so the statement of one who said he was a mufrid is negated. And we have mentioned in what preceded in this chapter from Hafsa that she said to the Messenger of Allah (peace and blessings of Allah be upon him): What is the matter with the people, they have exited ihram, and you have not exited from your Umra? So he said: I have garlanded my sacrificial animal and matted my head, so I shall not exit until I sacrifice. So that proves what we mentioned, and that that sacrificial animal was a sacrificial animal by reason of an Umra intended for qiran or tamattu. So we considered that, and the hadith of Hafsa, may Allah be pleased with her, proves that that statement of the Messenger of Allah (peace and blessings of Allah be upon him) was in Mecca, for it was from him after the people had exited ihram. And it is possible that the Prophet (peace and blessings of Allah be upon him) had performed tawaf before that or had not performed tawaf. If he had performed tawaf before that, then entered ihram for Hajj afterwards, then he was a mutamatti and was not a qarin, for he only entered ihram for Hajj after finishing the tawaf of Umra. And if he had not performed tawaf before that until he entered ihram for Hajj, then he was a qarin, for Hajj had become binding upon him before his tawaf for Umra. Since that admits what we mentioned, the most proper thing for us is to carry these reports upon that in which they agree, not upon that in which they contradict. And Ali ibn Abi Talib, Ibn Abbas, Imran ibn Husayn, and Aisha, may Allah be pleased with them, we have narrated from them that the Messenger of Allah (peace and blessings of Allah be upon him) performed tamattu, and we have narrated from them that he performed qiran, and it is established from his statement what proves that he arrived at Mecca and had not entered ihram for Hajj before that; so if we make his ihram for Hajj to have been before the tawaf for Umra, both hadiths are established, and the Messenger of Allah (peace and blessings of Allah be upon him) had been a mutamatti until he entered ihram for Hajj, then became a qarin. And if we make his ihram for Hajj to have been after his tawaf for Umra, we make him a mutamatti and negate that he was a qarin. So it is established thereby that his tawaf for Umra was after his ihram for Hajj, and it is established thereby that the Messenger of Allah (peace and blessings of Allah be upon him) was in the Farewell Hajj a qarin. Then one who dislikes qiran and tamattu said to those who approve them: you have argued against us by the statement of Allah, Mighty and Majestic: (Whoever performs tamattu with Umra to Hajj, then whatever sacrificial animal is feasible), for the permissibility of tamattu, but that is not so; rather the interpretation of this verse is what was narrated from Abdullah ibn al-Zubayr. Then he mentioned what.
