7310 - And they argued for that with what more than one of our companions, may Allah have mercy upon them, narrated to me - among them Ali ibn Said ibn Bashir al-Razi, who said: Abu Hammam al-Walid ibn Shuja al-Kufi narrated to us, he said: My father narrated to us, he said: Abu Khaythamah narrated to us, he said: al-Husayn al-Kufi ibn al-Harr narrated to us, he said: Isa ibn Abdillah ibn Malik narrated to me, from Muhammad ibn Amr ibn Ata, may Allah be pleased with him, one of Banu Malik from Ayyash - or Abbas ibn Sahl al-Saidi - and he was in a gathering in which was his father, and he was of the Companions of the Messenger of Allah (peace and blessings of Allah be upon him), and in the gathering were Abu Hurayrah, Abu Usayd, Abu Humayd al-Saidi and the Ansar, may Allah be pleased with them, that they recalled prayer. Abu Humayd said: I am the most knowledgeable of you of the prayer of the Messenger of Allah (peace and blessings of Allah be upon him); I followed that from the Messenger of Allah (peace and blessings of Allah be upon him). They said: Then show us. So he stood praying while they looked, and said takbir and raised his hands at the first takbir, then he mentioned a long hadith, in which he mentioned: when he raised his head from the second prostration of the first rakah he stood and did not sit cross-legged. So when this hadith came as we mentioned, opposing the first hadith, it may be that what the Messenger of Allah (peace and blessings of Allah be upon him) did in the first hadith was due to an ailment in him, so he sat because of it, not because that is of the sunnah of prayer - just as Ibn Umar, may Allah be pleased with them both, used to sit cross-legged in prayer, and when asked about that said: My legs do not carry me. So likewise it may be that what the Messenger of Allah (peace and blessings of Allah be upon him) did of that sitting was due to an ailment that befell him, so that it does not contradict what was narrated from him in the other hadith, nor oppose it. And this is more worthy for us than carrying what was narrated from him upon contradiction and opposition. And in the hadith of Abu Humayd also is Abu Humayd's narration of what was narrated in the presence of the Companions of the Messenger of Allah (peace and blessings of Allah be upon him), and none of them disapproved that against him. So that indicated that what is with them therein does not oppose what he narrated to them. And in the hadith of Malik ibn al-Huwayrith, may Allah be pleased with him, in Ayyub's speech, is that what Amr ibn Salamah used to do thereof, the people were not seen doing it - and he had seen a group of the followers. So that is a proof in repelling what was narrated from Abu Qilabah from Malik that it be a sunnah. Then rational examination after this agrees with what Abu Humayd, may Allah be pleased with him, narrated: we saw that when a man moves in his prayer from a state to a state, he begins remembrance. Of that: we saw him, when intending bowing, say takbir and fall bowing; when raising his head from bowing, say: Allah hears him who praises Him; when falling from standing to prostration, say: Allah is Greatest; when raising his head from prostration, say: Allah is Greatest; when returning to prostration, do that also; and when raising his head he does not say takbir after raising his head until he stands upright, other than one takbir. So that indicated that there is no sitting between his prostration and his standing. Had there been sitting between them, his takbir after raising his head from prostration would need to be for entering that sitting, and he would need another takbir when rising for standing. Since he was not commanded with that, it is established that there is no sitting between rising from the last prostration and standing to the rakah after it, so that its ruling and the ruling of the rest of prayers agree, not differ. So with this we take, and it is the saying of Abu Hanifah, Abu Yusuf and Muhammad ibn al-Hasan, may Allah's mercy be upon them all.
