Chapter 68: What has come concerning preemption (shuf'ah). 698 - Mahmud ibn Adam narrated to us, he said: Sufyan narrated to us, from Abu al-Zubayr, from Jabir, may Allah be pleased with him, from the Prophet (peace and blessings of Allah be upon him) who said: Whoever among you has land or palm trees, let him not sell it until he has offered it to his partner.

699 - Ali ibn Khashram narrated to us, he said: Abdillah - meaning Ibn Idris - informed us, from Ibn Jurayj, from Abu al-Zubayr, from Jabir ibn Abdillah, may Allah be pleased with them both, he said: The Messenger of Allah (peace and blessings of Allah be upon him) judged preemption in every undivided partnership, whether land or wall; it is not lawful for him to sell until he informs his partner; if he wishes he takes, and if he wishes he leaves; but if he sells without informing him, he has more right to it.

700 - Muhammad ibn Yahya narrated to us, he said: Abd al-Razzaq narrated to us, from Ma'mar, from al-Zuhri, from Abu Salamah, from Jabir ibn Abdillah, may Allah be pleased with them both, he said: The Messenger of Allah (peace and blessings of Allah be upon him) made preemption only in what has not been divided; when the boundaries fall and the roads are arranged, there is no preemption.

He said: And Abu Asim narrated to us, from Abdillah ibn Abd al-Rahman, from Amr ibn al-Sharid, from his father - and this is the hadith of Abu Asim - he said: The Messenger of Allah (peace and blessings of Allah be upon him) said: The neighbor has more right to his saqab. Abu Nu'aym added: He said: I said to Amr: What is his saqab? He said: Preemption. I said: People claim it is proximity? He said: People say that.
