Chapter 340 - Explanation of the difficulty in what was narrated from the Messenger of Allah (peace and blessings of Allah be upon him) concerning the stallion which he forbade taking in charity. 2128 - Ibrahim ibn Marzuq narrated to us, he said: Muhammad ibn Abdullah al-Ansari narrated to us, he said: My father narrated to me, from Thumama, from Anas that in the book Abu Bakr al-Siddiq wrote concerning charity, and he wrote therein for him: It is the charity of the Messenger of Allah (peace and blessings of Allah be upon him) which Allah Almighty obligated upon His creation, so whoever is asked above it, give him not: That there be not taken in charity an old, nor one with defect, nor a billy-goat, except if the collector wills. And thus Ibrahim narrated it to us with kasr, meaning thereby the governor over charity.

2130 - And likewise al-Rabi ibn Sulayman al-Muradi narrated to us, from Asad, from Hammad, each of them mentioned this letter with kasr. Abu Jafar said: And Ali ibn Abd al-Aziz permitted me from Abu Ubayd that he said: The hadith scholars say in this hadith: Except if the collector wills, with kasr, while I see it: Except if the collected-from wills, with fath, meaning the owner of wealth. Abu Jafar said: And it is in my view as Abu Ubayd said, and Allah knows best, for if the billy-goat exceeded the age obligatory upon the owner in what is obligated in his wealth, it would be unlawful for the collector to take it for what is therein of increase over the obligatory upon its owner taken from him, and if it were below the obligatory upon its owner, it would be unlawful for the collector to take it from its owner for what is upon him in his wealth of what is above it, and if it were like it in value, it is other than the kind ordered to be taken for its obligatoriness upon its owner, so unlawful for him to take it without its owner's goodwill, so that indicates the collector was not intended by what is mentioned in this hadith, and the intended thereby is the owner of wealth not the collector, so to him is the choice to give above what is upon him or like what is upon him of other than the kind of what is upon him, and to the collector is acceptance thereof from him if he sees that as benefit for what he administers of charity, and we ask Allah Almighty for guidance.

2130 - اور اسی طرح ہم سے ربیع بن سلیمان مرادی نے بیان کیا، اسد سے، حماد سے، ان میں سے ہر ایک نے اس حرف کو کسر سے ذکر کیا۔ ابو جعفر نے کہا: اور مجھے علی بن عبد العزیز نے ابو عبید سے اجازت دی کہ انہوں نے کہا: محدثین اس حدیث میں کہتے ہیں: مگر یہ کہ مصدق چاہے، کسر سے اور میں دیکھتا ہوں: مگر یہ کہ مصدق چاہے فتح سے یعنی مال کے رب کو چاہتے ہیں۔ ابو جعفر نے کہا: اور وہ میرے نزدیک جیسا ابو عبید نے کہا - واللہ اعلم - کیونکہ بکرا اگر مال کے رب پر واجب سن سے تجاوز کرے اس میں جو اس کے مال میں اس پر واجب ہو تو مصدق پر اسے لینا حرام تھا اس میں جو اس کے رب پر واجب پر زیادتی ہے اس سے ماخوذ میں سے، اور اگر وہ اس کے رب پر واجب سے دون ہو تو مصدق پر اسے اس کے رب سے لینا حرام تھا اس پر جو اس کے مال میں ہے اس میں سے جو اس سے فوق ہے، اور اگر وہ قیمت میں اس جیسا ہو تو وہ اس نوع کے خلاف ہے جسے لینے کا حکم دیا گیا اس کے رب پر اس کے وجوب کے لیے، تو اس پر اسے اس کے رب کی نفس کی خوشی کے بغیر لینا حرام ہے، تو یہ دلالت کرتا ہے کہ مصدق اس سے مراد نہ تھا جو اس حدیث میں ذکر کیا گیا، اور اس میں مذکور سے مراد مال کا رب ہے نہ مصدق، تو اسے اختیار ہوگا کہ وہ اس پر جو ہے سے فوق دے یا اس پر جو ہے جیسا اس نوع کے خلاف میں سے جو اس پر ہے، اور مصدق کے لیے اس سے اس کا قبول ہوگا اگر وہ اسے اس صدقے کے فائدے میں دیکھے جسے وہ سنبھالتا ہے، اور ہم اللہ عزوجل سے توفیق مانگتے ہیں۔
