7 - Chapter: obligation of wiping the head in ablution. 128 - Yunus, Abd al-Ghani ibn Abi Aqil, and Ahmad ibn Abd al-Rahman narrated to us, they said: Ibn Wahb informed us, he said: Yahya ibn Abdillah ibn Salim and Malik ibn Anas informed me, from Amr ibn Yahya al-Mazini, from his father, from Abdillah ibn Zayd ibn Asim al-Mazini, from the Messenger of Allah (peace and blessings of Allah be upon him), that he took with his hand in his ablution for prayer water, and began with the front of his head, then went with his hand to the back of the head, then returned them to its front. Malik said: This is the best I heard in that, and the most general in wiping the head.

131 - Ibn Abi Dawud narrated to us, he said: Ali ibn Bahr narrated to us, he said: al-Walid ibn Muslim narrated to us, he said: Abdillah ibn al-Ala narrated to us, from Abu al-Azhar, from Muawiyah, that he showed them the ablution of the Messenger of Allah (peace and blessings of Allah be upon him). When he reached wiping the head, he placed his palms upon the front of his head, then passed them until he reached the nape, then returned them until he reached the place from which he began. Some holders held that wiping the whole head is obligatory in the ablution for prayer, and abandoning any of it does not suffice, and they argued for that with these reports. Others disagreed with them and said: What is in these reports of yours is only that the Prophet (peace and blessings of Allah be upon him) wiped his whole head in his ablution for prayer; thus we order one performing ablution to do that in his ablution for prayer, but we do not oblige that in its entirety upon him as duty. And there is nothing in the act of the Prophet (peace and blessings of Allah be upon him) doing it that has indicated that was from him because it is duty, for we have seen him (peace and blessings of Allah be upon him) perform ablution thrice each, not that that is duty than which less does not suffice, but of it is duty and of it is excellence. And there has been reported from the Prophet (peace and blessings of Allah be upon him) of the reports indicating what they held about duty in wiping the head being upon part of it that which [follows].

133 - Husayn ibn Nasr narrated to us, he said: I heard Yazid ibn Harun say: Ibn Awn informed us, from Amir, from Ibn al-Mughirah ibn Shubah, from his father, and Ibn Awn, from Ibn Sirin, from Amr ibn Wahb, from al-Mughirah, raising it to him, he said: We were with the Messenger of Allah (peace and blessings of Allah be upon him) on a journey, and he performed ablution for prayer, so he wiped over his turban, and he mentioned the forelock with something. So in this report is that the Messenger of Allah (peace and blessings of Allah be upon him) wiped part of the head, namely the forelock, and the appearance of the forelock is proof that the rest of the head has the ruling of what appeared of it; for had the ruling been established by wiping over the turban, it would have been like wiping over the two leather socks, in which the two feet must have been concealed therein. Had part of the two feet been exposed, it would not have sufficed him to wash what appeared of them and wipe over what was concealed of them; rather the ruling of what was concealed of them was made attached to the ruling of what appeared of them. Since washing the apparent became obligatory, washing the concealed became obligatory. Likewise the head: since wiping what appeared of it became obligatory, it is established that it is not permissible to wipe what is concealed of it, so that the ruling of all of it is one ruling, as the ruling of the two feet, when part of them is concealed in the leather socks, was one ruling. Since the Prophet (peace and blessings of Allah be upon him) sufficed in this report with wiping the forelock over wiping the rest of the head, that indicated that the duty in wiping the head is the measure of the forelock, and that what he did beyond the forelock in the other reports was proof of excellence, not obligation, so that these reports agree and do not contradict. This is the ruling of this chapter by way of reports. As for by way of reasoning, we have seen that ablution is obligatory in limbs. Of them is what has the ruling of being washed, and of them is what has the ruling of being wiped. As for what has the ruling of being washed, it is the face, the two hands, and the two feet, in the saying of one who obliges washing them. All have agreed that what must be washed thereof must all be washed, and washing part of it to the exclusion of part does not suffice. And whenever there was what must be wiped thereof, namely the head, one group said: Its ruling is that all of it be wiped, as those limbs are all washed, and others said: Part of it is wiped to the exclusion of part. So we looked at how the ruling of wiping is. We saw that the ruling of wiping over the two leather socks has been disputed. One group said: Their outer is wiped to the exclusion of their inner, and others said: Their outer and inner are wiped. All have agreed that the duty of wiping therein is upon part of them to the exclusion of wiping all of them. By reasoning upon that, the ruling of wiping the head is likewise: upon part of it to the exclusion of part, by analogy and reasoning, upon what we explained of that. And this is the saying of Abu Hanifah, Abu Yusuf, and Muhammad ibn al-Hasan, may Allah have mercy on them. And there has been reported in that from those after the Prophet (peace and blessings of Allah be upon him) also that which agrees with that.
